This Credit Agreement is made the day of …… 2000 between you the customer whose name and address appears below and us ICS HIRE Ltd and references to you and your and we and ours shall be construed accordingly.

Definitions:

"Your motor car"                                  -     the motor car identified in the schedule

"The road traffic accident                   -     the accident identified in the schedule

"The third party"                                  -     the person identified in the schedule

"Inherited charges"                             -     the cost of collecting the damaged vehicle from a third-party   recovery company                

"Our storage charges"                         -     the cost of daily storage charges

"Our recovery charge"                         -     the cost of the recovery of your vehicle

Whereas:

6. Your motor car has been damaged in a road traffic accident dated 00/00/2000
7. It appears from the information provided by you to us that the road traffic accident was caused by the negligence of the third party;
8. You have been provided with daily rate of storage;
9. You wish to instruct us to store your vehicle until such time as the vehicle value has been agreed by the defendant;
10. We agree to store the vehicle on your behalf and to defer your obligation to pay us upon the terms which appear below;
11. You agree to pay us the daily sum set forth in our storage charges.
12. You agree to pay us the inherited charge for recovery (if applicable)
13. You agree to pay us the recovery charges

TERMS OF AGREEMENT

1. Subject to the overall time limit mentioned below we will defer your obligation to pay us until after the conclusion of any action to recover the cost of the repairs from the third party.
2. You must pay to us the cost of storage & recovery plus by a single payment:

(a) upon conclusion of any action to recover the cost of repair from the third party; or

(b) upon earlier recovery of the cost of storage & recovery:

 but in any event within 12 months beginning with the date of this Agreement.

3. You must also co-operate with us in the following ways:

(a) In the appointment of a Solicitor nominated by us to act on your behalf in prosecuting a claim for damages against the third party for the damage to your vehicle;

(b) In the prosecution of any claim against the third party.

4. You are free at any time to choose another Solicitor to act on your behalf or to act on your own behalf in prosecuting a claim against the third party but if you do so the credit provided by us to you will end and we will be entitled to ask you to pay us immediately.
5. Similarly, if you do not co-operate with the nominated Solicitor in prosecuting a claim against the third party, or any aspect of your claim is in any way fraudulent, the credit provided by us to you will end and we will be entitled to ask you to pay us immediately.
6. At any time after completion by us of the repairs we may assign our rights under this Agreement.
7. You have the right to cancel this contract if you wish and can do so by delivering, sending (including electronic mail) after you have agreed and signed this contract, we will then send you a copy of this credit recovery and storage agreement with the cancellation form by email to you on the same day. You can cancel at any time within 14 days starting with the day of receipt of this Notice.
8. By proceeding with SC Prime Ltd you acknowledge and agree to the Terms & Conditions set out in this document. You confirm that You have read and understood the content of this document

These Terms and Conditions shall be governed and interpreted in accordance with the laws of [Your Jurisdiction].
